FinCEN and the Federal Reserve withdraw the 2020 proposal to cut the cross-border Recordkeeping and Travel Rule threshold to $250 and to clarify coverage of convertible virtual currency
FinCEN and the Federal Reserve Board are withdrawing their joint notice of proposed rulemaking published on October 27, 2020, which would have lowered the Bank Secrecy Act Recordkeeping and Travel Rule threshold from $3,000 to $250 for funds transfers that begin or end outside the United States. The proposal would also have clarified that the rules apply to domestic and cross-border transactions involving convertible virtual currency (CVC) and digital assets with legal tender status, and the agencies say they will not take further action on it. FinCEN announced the withdrawal on November 06, 2026; the notice is scheduled for publication in the Federal Register on 2026-11-09.
